UP2DATE Software is a software development company based in Romania and acts as the data controller for the personal data described in this policy.

What data we collect

We collect form submissions and technical data needed to operate the site. Only with your permission do we also collect analytics and campaign measurement data:

• Form details: name, email, message and, if provided, phone, company and how you heard about us. Required fields are marked on each form.
• Technical data automatically logged by our hosting provider, such as your IP address, browser type and the pages you request, used to keep the site secure and available.
• Data processed by Google reCAPTCHA to tell humans from bots when you submit the contact form.

How and why we use it

We use your data to:

• Respond to your enquiry and discuss a potential project with you.
• Provide and improve our services and this website.
• Protect the site against spam, abuse and security threats.
• Meet our legal and accounting obligations.

Legal basis (GDPR)

We process your contact-form data to take steps at your request before entering into a contract, and on our legitimate interest in responding to enquiries. Technical and security data is processed on our legitimate interest in operating a safe, reliable website. Where we rely on consent, you can withdraw it at any time.

Service providers we use

We use the following providers to operate the site and communicate. Optional analytics and advertising tools start only after acceptance:

• Google Firebase (Google Ireland Ltd / Google LLC) — website hosting and database storage of contact requests.
• Google reCAPTCHA — bot protection on the contact form, subject to the Google Privacy Policy and Terms of Service.
• Google Workspace (Gmail) — we receive contact-form notifications at office@up2date.ro.
• Google Analytics and Google Ads through Google Tag Manager, LinkedIn Insight Tag, Microsoft Clarity and OpenAI Ads — visit and interaction analytics, session recordings with form fields masked, and campaign measurement. They may process identifiers, IP addresses, browser information, pages and events. With consent, OpenAI Ads may receive the conversion ID, attribution identifiers and a SHA-256 hashed email for matching; hashed data remains personal data.

International transfers

We host data within the EU where possible. Some providers (e.g. Google) may process data outside the European Economic Area; in those cases the transfer is covered by the European Commission’s Standard Contractual Clauses or an equivalent safeguard.

How long we keep it

We keep contact-form messages for as long as needed to handle your enquiry and any resulting business relationship, and afterwards only as long as required to meet legal obligations. Technical logs are kept for a short period for security purposes.

Your rights

Under the GDPR you have the right to:

• Access the personal data we hold about you.
• Have inaccurate data corrected.
• Have your data erased where the law allows.
• Restrict or object to certain processing.
• Receive your data in a portable format.
• Withdraw consent at any time.
• Lodge a complaint with the Romanian Data Protection Authority (ANSPDCP, dataprotection.ro).

Cookies

Optional analytics and advertising tools and attribution storage start only after “Accept all”. You can use the site and submit forms with “Essential only”. Google reCAPTCHA loads when you interact with a form for bot protection.

The explicit choice is stored in localStorage (u2d_cookie_consent) for up to 180 days. With permission, campaign parameters and click identifiers are stored in u2d_attribution for up to 90 days from the attributed visit and may accompany your submitted request. Provider data and cookies follow the retention periods set by those providers and the respective account settings.

Withdraw consent using “Cookie settings” in any page footer and selecting essential cookies only. We stop optional tools, remove local attribution and measurement cookies accessible to the site, and reload the page to stop scripts already running. Withdrawal does not automatically erase data already sent to providers or affect the lawfulness of earlier processing. Contact us for deletion requests.

Changes to this policy

We may update this policy from time to time. The “last updated” date above always reflects the current version.
